What is a deposition?

Depositions are used to gather a complete profile of facts and testimonies that involve an attorney’s current case. Every called-upon witness of questioned under oath, and the events are recorded by a court reporter verbatim for both legal counsels to use. They are not legally required, but they are a key resource for every attorney.

Why hold a deposition?

Depositions allow attorneys to craft a more concise presentation to use in the court room. They can go over what was said by witnesses to create an impenetrable testimony. Discrepancies between what is said in the deposition and in-court testimony open up holes for the opposing counsel to poke, something an attorney can avoid by hosting a deposition.

Guarantee an impenetrable case

Consistency is key! Depositions give the opposing counsel no room to find problems with the story, but that being said, the best thing a witness can do is tell the truth. Also remind your witness to let the attorney finish speaking before answering a question, and to speak slowly and clearly. Tell your witness it is perfectly acceptable to ask for clarification on a question so they can give the best answer possible.
